IMPLEMENTASI AKAD BA’I AL-ISTISHNA UNTUK PEMESANAN PARSEL HARI RAYA DI KOPERASI AS SAKINAH SIDOARJO
Buying and selling by means of Bai' al-Istishna’ is the right solution offered by Islam to avoid usury. However, often in practice in the field there is often negligence by the Muslim ilaih (the seller) in fulfilling his dependents. This article attempts to analyze the implementation of the Ba’i al-istishna contract for ordering holiday parcels at the As Sakinah Sidoarjo Cooperative. To review the istishna contract, a data source is needed that is used as a theoretical basis, namely the opinions of scholars and also experts in the field of Muamalah Fiqh by taking from books, journals, and relevant articles. This article finds that the practice of the Bai' al-Istishna’ contract carried out by the As Sakinah Sidoarjo Cooperative is in accordance with Islamic law. So neither side feels disadvantaged. As Sakinah Cooperative prioritizes the satisfaction of every buyer. This can be seen from the accuracy of the cooperative employees in choosing the specifications of the goods that are really in accordance with what is desired by the buyer. Although in some practices the As Sakinah Cooperative often experiences problems, especially in terms of capital rights, the provision of a down payment to the As Sakinah Cooperative greatly helps reduce the risk of the As Sakinah Cooperative's lack of capital. Of course, all of this is based on mutual pleasure.
